Raffle Rules

1. Introduction
1 These Rules apply to registered users of the Raffle.

2. Definitions

  •  “Draw” The process by which winners are selected
  • “Raffle” The order based Nairagenieraffle Raffle
  • “Member” An individual who has registered with the Raffle
  • “Rules” The rules of the Raffle as set out herein and amended from time to time
  • “Nairagenieraffle” Nairagenieraffle and Mirabile Ventures Ltd
  • “Apple” Apple Inc. www.apple.com

3. Entry into the Raffle

3.1 In order to comply with the rule, and to purchase the raffle you will be required to confirm/agree that

  • (a) You have to be a registered user
  • (b) You must have a valid email address
  • (c) You are at least 16 years of age
  • (d) You will not buy or claim to buy raffles on behalf of any other person
  • (e) You must always use the order number as a reference when you make any payments into our bank account.
  • (f) You agree that the raffle that have been purchased and entered into the draw cannot be refunded unless the raffle is cancelled by us or failed for any reasons (e.g. not enough participants).
  • (g) We have the right to cancel the raffles or extend Raffles end date.
  • (h) Apple or Apple Inc. is not a sponsor and not involved in Raffles in any way.

3.2 By registering as a user you agree to be bound by these Rules, and the applicable provisions and/or any relevant regulations made thereunder from time to time.

3.3 Nairagenieraffle shall not be liable for any loss or damage (including loss of the opportunity to enter the Raffle and / or the right to receive a prize) suffered by you if you have not complied with the Rules.

3.4 The Rules may be amended by Nairagenieraffle from time to time and any changes will be posted on the website.

3.5 You may be required to provide payment information relating to the purchase of your Raffle order. (i) The information required will depend upon the payment method

3.6 Nairagenieraffle shall be entitled to take any steps necessary to verify the above information      and to process your registration.

3.7 Nairagenieraffle may refuse to accept your registration as a user or cancel your Raffle purchase

3.8 It is your responsibility to ensure that the personal information you provide to us is accurate and the Nairagenieraffle cannot be held liable for any error.

4. Payment

  • Payment for Raffles may be made by the following methods
    • (a) Direct Debit
    • (b)Direct Transfer
    • (c)  Wallet
    • (d) Any other method made available from time to time

4.2 Where payment for Raffles are made directly, the following applies:

  • (a) Direct Debit payments will be referenced as Mirabile Ventures Ltd on your bank statement..
  • (b) Any other method made available from time to time would also be referenced as or be payable to Mirabile Ventures Ltd on any appropriate documentation.

4.3 You will not be entered into the Raffle unless Nairagenieraffle has received all amounts payable (cleared funds) relating to your order within 2 days of placing the order. If there is a dispute regarding whether orders have been paid for then such dispute shall be resolved by reference to payment details and records held by Mirabile Ventures Ltd banker.

4.4 You may cancel your registration at any time by notifying Nairagenieraffle by e-mail (or via any other methods notified to you by Nairagenieraffle from time to time). Upon receipt of this notice Nairagenieraffle will cancel your registration as soon as is reasonably practicable.

4.5 Nairagenieraffle may cancel your entry into the Raffle at any time. You will be notified accordingly as soon as reasonably practicable and will be reimbursed any amounts which have been paid but which relate to future Raffle. Other than the reimbursement of any such amounts, Nairagenieraffle shall not be liable for any loss or damage (including loss of the opportunity to enter the Raffle and / or the right to receive a prize) suffered by you in relation to such cancellation.

5. Prizes

5.1 Nairagenieraffle reserves the right to amend the prizes at any time. Any such changes will be published on the Nairagenieraffle website.

5.2 The results of each Raffle will be published on the Nairagenieraffle website immediately after the Raffle is ended and may also be published in any other manner determined by Nairagenieraffle from time to time.

5.3 Winners will be notified by e-mail and published on our website immediately after the Raffle has ended.

5.4 Nairagenieraffle reserves the right to withhold the Raffle prize until it is entirely satisfied that the user who has won the prize has fully complied with the Rules.

5.5 Any uncollected prizes after a period of 3 months has elapsed will be forfeited.

6. Suspension of the Raffle

6.1 Nairagenieraffle may (at its absolute discretion) suspend the Raffle for any period of time. During such period, Nairagenieraffle shall:

  • (a) Suspend Direct Debit payments from your bank account as soon as reasonably practicable, and;
  • (b) Retain any amounts which were paid prior to such suspension taking effect that have not been used to pay for Raffles in previous Draws.

You will be notified of further details regarding the resumption of the Raffle or otherwise as soon as reasonably practicable after the date of suspension by email.

7. Liability

7.1 Neither Nairagenieraffle nor Mirabile Ventures Ltd is not liable to you for any loss or damage suffered by you arising from:

  • (a) Any delays or failures in the postal service or other delivery methods used by the Mirabile Ventures Ltd, Nairagenieraffle or you from time to time.
  • (b) Any delays or failures in any systems used by the Mirabile Ventures Ltd, Nairagenieraffle or you to transmit e-mails.
  • (c) Any failure in any software or other systems used by the Mirabile Ventures Ltd, Nairagenieraffle for the administration of the Raffle.
  • (d) Any delays of failures in the banking system used by the Mirabile Ventures Ltd, Nairagenieraffle or you.
  • (e) Any refusal by the Mirabile Ventures Ltd and/or Nairagenieraffle to accept registration of an individual as a registered user or the cancellation of a registered user by the Mirabile Ventures Ltd and/or Nairagenieraffle.
  • (f) Any failure to enter your order into the Raffles.
  • (g) Any event beyond the reasonable control of either the Mirabile Ventures Ltd and/or Nairagenieraffle.

7.2 Neither Nairagenieraffle nor Mirabile Ventures Ltd shall be liable to you in contract, tort, negligence or otherwise for any indirect or consequential loss suffered by you in relation to your participation in the Raffle (including loss of the opportunity to enter the Raffle and / or the chance of winning a prize).

8. Complaints

8.1 Any complaints relating to the Raffle should be sent in writing to Nairagenieraffle, giving full details of the complaint and supporting documentation

8.2 Nairagenie shall make the final decision on the complaint pursuant to the Rules and that decision shall be final and binding.

8.3 Save where the Rules expressly provide otherwise, Nairagenieraffle shall not be obliged to enter into any correspondence.

8.4 If a satisfactory resolution cannot be reached then the matter can be referred to an alternative dispute resolution (ADR) entity. This service is free of charge.

9. Privacy

9.1 Nairagenieraffle is committed to protecting your privacy. Data that we collect from you is used lawfully in accordance with the General Data Protection Regulation and is used solely for the purpose of processing your purchase of Raffles, subsequent entry into the Raffle, and informing you if you have won a prize.

9.2 You have the right to make a subject access request to access the information Both the Mirabile Ventures Ltd and Nairagenieraffle holds about you. To obtain this information, please contact Nairagenieraffle in writing. You will be asked to provide proof of your identity prior to your subject access request being dealt with and personal information being disclosed to you.

9.3 Neither Mirabile Ventures Ltd nor Nairagenieraffle will sell, rent or grant access to any of the personal data we collect about you to any third parties.

9.4 Nairagenieraffle may share aggregated information to third parties. This will not contain personal information that can identify any individual person.

9.5 Either the Mirabile Ventures Ltd or Nairagenieraffle may be obliged to disclose your personal information if required to do so by law, for example to statutory bodies such as the Gambling Commission or other government bodies.
